Kenny Stabler arrested for DUI -- again

Postby dolfan » June 9th, 2008, 6:04 pm

Third one. Happened Sunday night. Word is UA will cut him loose from his role as color analyst for the Bama radio broadcast. Shame. Love the Snake, love to listen to him. That's what the hooch will do for you.

Update: Stabler has taken a leave of absence from the Bama broadcast team for the 2008 season. Tentative plans to return in 2009. If Jay Barker takes that seat, you've seen the last of the Snake in it.

Breaking news tonight from Municipal Court (night court) in Robertsdale, Alabama, where Ken Stabler was pulled over and arrested for DUI in July. He was acquitted tonight after a 3 hour trial. Stabler had refused a breath test (which is always my professional advice, even though it'll cost you a license). The arresting officer administered a field sobriety test that he testified Stabler was unable to perform. Judge said he didn't prove it well enough.

There is no law against drinking and driving. I've seen videos of people whom police said "failed" the field sobriety tests but who never stumbled or bobbled even. I don't know what happened, and my guess is he got a big favor. But, anyway, he's been acquitted.

If no law, why the need for a DUI ticket? That doesn't make for good rationale.

The law is against driving under the influence of alcohol, not driving after drinking alcohol. That's why there are limits on BAC, which limits define what "under the influence" is, not simply whether there is a BAC at all. And, the other method of proving DUI than BAC is field sobriety. In this case, this court believed that the police officer didn't establish "driving under the influence" with sufficient proof of enough failure of field sobriety indicators. My point was simply that it takes more than proof of drinking alcohol before driving to rightly convict for DUI. And, apparently here, the only thing that could be proved was consumption before driving. That, alone, is not criminal.
