There's just no evidence how she views the role of a judge. None that I've seen.
Here's the West database profile of Ms. Miers. I've added some editorial comment in
Current Employment Position(s):
White House Counsel
Areas of Practice:
Antitrust & Trade Regulation
Litigation & Appeals
Bar Admissions:
Texas, 1970
Was she never even admitted to practice before any Federal court? If so, this doesn't state so. Typically, every court to which you are admitted to practice gets listed in these vitaes. For instance, I'm admitted to the Alabama State Bar, and to the U.S. District Court, Northern District of Alabam and Middle District of Alabama. I am not admitted to practice before the 11th Circuit or the US Supreme Court; those require separate applications that most lawyers do not undertake unless they have a reason to. My question is whether, beyond regulatory advice and executive experience, Ms. Miers has any experience in Federal court litigating Federal issues in her practice area. It simply doesn't appear so on this very cursory outline.
Education:
Southern Methodist University School of Law, Dallas, Texas, 1970
J.D., Juris Doctor
Honors: Barristers, Moot Court Board, Kappa Beta Pi
Law Review: Comments Editor, Southwestern Law Journal, 1969 - 1970
Southern Methodist University, Dallas, Texas, 1967
B.S., Bachelor of Science (in Mathematics, according to Pres. Bush today)
Classes/Seminars Taught:
Former Trial Advocacy Instructor, SMU NITA [National Institute of Trial Advocacy] Program, Southern Methodist University School of Law (just means she was a mock trial coach for their competition teams; I was on Alabama's; as a rule, these things are coached by left-of-center types, just FYI).
Honors and Awards:
Sustaining Life Fellow, Texas Bar Foundation
Charter Member, Fellows of the Dallas Bar Foundation
Fellow, American Bar Foundation
DAYL Outstanding Young Lawyer of Dallas, 1979
Recognized as Belo Hero for role in Dallas Bar's Acquisition of the Belo Manson
Sarah T. Hughes Award, Women in the Law Section, State Bar of Texas, 1993 (Pres. Bush said she'd won the Sandra Day O'Connor award, but that isn't listed here. Could this have been the one he meant?)
National Award for Leadership and Commitment from Girls Clubs, 1987
American Jewish Committee, Human Relations Award, 1992
Justinian Award for Community Service, 1992
Professional Associations and Memberships:
State Bar of Texas, 1992 - 1993

State Bar of Texas
Former Vice Chair, Antitrust Section Council [Antitrust is a big theme in her career. Could be good, could be bad. She is going to be, I think, naturally biased toward an expansive view of the commerce clause. This WOULD BE, IF TRUE, antithetical to a Rehnquist/Scalia/Thomas view.]
American Bar Association
Former Chair, Young Lawyers Division, Antitrust Subcommittee
American Bar Association
Former Co-Chair, Committee on Business Torts, Section of Litigation [Again, this could indicate a cut in either direction. Texas is notorious for its limitations on recovery in medical malpractice cases and designing their laws to protect HMO's. Was Ms. Miers a voice against that in the ABA? If so, would that, in turn, mean that she's more likely to oppose caps on recoveries as somehow a deprivation of due process? Hmmm...]
American Bar Association
Former Member, Consortium on Delivery of Legal Services to the Public [There are about 3 good lawyer jokes in that title alone, but I won't bother.]
Dallas Legal Services
Former Member, Board [Read: Legal Aid. I'm glad they're here, and they are needed, but does this show where her philosophical influences lie? They are mostly very liberal who are passionate about public legal aid. But, I do a lot of pro bono work, and I'm certainly no liberal. Just pointing out possibilities.]

[Pause. This woman's goal was something else, not to be the brightest legal mind or a Supreme Court justice. She has a very political path laid out here. This causes me some amount of distrust. Academes, scholars, judges, and even attorneys whose experience is heavily federal form a worthy pool. This lady just looks ... lacking.]
